Apple co-founder Steve Wozniak won The latest legal round in his battle with YouTube is over the doctored video of him that was circulated by the platform to promote a Bitcoin fraud. San Jose court of appeals ruling reversed a lower court decision that absolved the video platform from any liability.

YouTube is not allowed to use the Contentious Communications Statute as a protection. Apple’s co-founder will be able to proceed with his case against YouTube after the verdict. Wozniac’s campaign may also result in a federal law change. Video-streaming platforms are protected from liability for videos that they post under the current law.

Wozniac’s name isn’t the only one that stands out in this lawsuit. It was filed in 2020, against YouTube as well as its parent, Google. It also included signatures of 17 additional individuals. List includes Microsoft founder Bill Gates and Tesla, SpaceX CEO Elon Musk as well as Dell co-founder Michael Dell.

In the video that went viral in 2020 viewers were offered Bitcoins (BTC) for free. The video also asked the viewers to send BTC (Bitcoin) to an account to get their money doubled.

Santa Clara County Superior Court has ruled that Section 230 Communications Decency Law protects companies from any liability. In its ruling, however, the court of appeal pointed out that YouTube is often used to hack into channels and promote scams. Additionally, the court highlighted that the platform is responsible for ‘materially contributing’ to the scam by ‘providing verification badges to hijacked YouTube channels.’

YouTube also failed to remove verification badges from the channel when they started uploading scam videos, according to the court.

Wozniac’s lawyer, Joe Cotchett, stated how ‘Google and YouTube are responsible for the actions they take and can’t use Section 230 to shield their behavior.‘
